**Acceptance of Terms of Use**
The Terms of Use apply to your use of the content and features existing on the name italianospizza.co.il, as well as other websites and applications where these terms appear or are linked (hereinafter collectively: the “Platform”), which are operated by Cheese, Slice, Factory Ltd. (hereinafter: “Italianos Pizza”). Use, visiting, or browsing our website constitutes your confirmation and agreement to be bound by these Terms of Use. If you do not agree to the following terms, you must refrain from using the Platform. These Terms of Use constitute an ongoing agreement between you and Italianos Pizza regarding the use of the Italianos Pizza Platform.

**Changes to the Terms of Use**
Italianos Pizza reserves the right to change the Terms of Use from time to time at our sole discretion, with or without prior notice. You can view the updated version of the Terms of Use by clicking the “Terms of Use” link at the bottom of the website pages. The most current version of the Terms of Use shall supersede previous versions. Continued use of the website after changes constitutes your agreement to be bound by the changes made.

**Privacy and Personal Information**
Italianos Pizza is committed to protecting the privacy of the personal information you enter on the site. All information transmitted to the site is subject to the Privacy Policy, the terms of which are set forth above. To understand our procedures, please review the Privacy Policy. The modification date of the Privacy Policy will be indicated below the policy. You can view the Privacy Policy by clicking the “Privacy” link at the bottom of the website pages.

**Your Account**
After opening an account on the site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. The site sells products to adults who can make purchases using credit cards. If you are under 18, you may browse the site, but not open an account, purchase products, or participate in offers or campaigns. Italianos Pizza reserves the right to refuse service, close accounts, remove or edit content, or cancel orders at its sole discretion.

**Your Consent**

• Some site features require opening an account. It is prohibited to use another user’s account without permission. When opening an account, you must provide accurate and complete information. You are solely responsible for activities performed under your account, and you must protect your account password. You must immediately notify Italianos Pizza Online of any security breach or unauthorized use of your account. Although Italianos Pizza Online will not be held liable for losses incurred due to unauthorized use of your account, you may be held liable for losses incurred by Italianos Pizza Online or others as a result of such unauthorized use.
• You agree not to use or operate any automated system, including but not limited to “robots,” “spiders,” “offline readers,” etc., that access the site and produce multiple requests to the Italianos Pizza Online servers in a given timeframe, the number of which significantly exceeds the requests produced in the same timeframe by a visitor using a conventional browser. Italianos Pizza Online reserves the right to revoke search engine permissions broadly or in specific cases. **Limitation of Liability**
Cheese, Slice, Factory Ltd., its managers, employees, or agents shall not be liable for any direct, indirect, incidental, special, circumstantial, or punitive damages resulting from (i) errors, mistakes, or inaccuracies in content, (ii) personal injury or property damage of any kind resulting from your access to or use of the site, (iii) any unauthorized access to or use of our secure servers and/or any personal and/or financial information stored therein, (iv) any interruption or cessation of communication from or to the site, (v) bugs, viruses, Trojan horses, or the like that may be transmitted to or through the site by any third party, and/or (vi) errors or omissions in content or any loss or damage incurred as a result of your use of content posted, emailed, or otherwise made available on the Italianos Pizza Online website, whether based on warranty, contract, tort, or any other legal theory, and whether or not Cheese, Slice, Factory is advised of the possibility of such damages. The limitation of liability below shall apply to the fullest extent permitted by law in the applicable jurisdiction. You expressly acknowledge that Italianos Online shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any user or third party, and that the risk of harm or damage from the foregoing rests entirely with you. The site is controlled and offered by Cheese, Slice, Factory Online from its offices at 1 Dudman, Mazkeret Batya. Cheese, Slice, Factory does not warrant that the Italianos Pizza Online website is appropriate or available for use in other locations. Visitors or users of the site from other jurisdictions do so of their own volition and are responsible for compliance with local legal requirements.

**Indemnification**
You agree to defend, indemnify, and hold harmless Cheese, Slice, Factory, its parent corporations, as well as the officers, directors, employees, and agents of the company’s partners, from and against any claims, damages, losses, liabilities, costs, or debts, and expenses (including but not limited to legal fees) arising from: (i) your use and access to the site; (ii) your violation of any of the Terms of Use; (iii) your violation of any third-party right, including but not limited to copyright, property, or privacy rights; or (iv) any claim that one of your user submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Use and your use of the site.

**Eligibility**
You hereby certify that you are 18 years of age or older, an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use. In any case, you affirm that you are over 18 years of age, as the Italianos Pizza Online website is not intended for children under 18. If you are under 18, please refrain from using the Italianos Pizza Online website—you can find many other excellent sites that are suitable for you. You should talk to your parents about sites that are appropriate for your age.

**Third-Party Advertisements**

**Cancellation of Transaction**
Transaction cancellation in accordance with the Consumer Protection Regulations (Transaction Cancellation), 2010, and the Consumer Protection Law, 1981.

**Launch Pricing Policy**
The company charges a delivery fee (10-50 NIS) according to defined areas, in addition to the product price as advertised on the site. However, for the sake of clarity, it is noted that there may be differences between the product price for pickup from a branch and its price for delivery as advertised on the site—at the customer’s choice.

**Minimum Order**
The minimum order for delivery is 50 NIS. There is no minimum order for self-pickup.

**Use of Coupons and Gifts**
It is not possible to use more than one coupon per order. You must wait half an hour between orders if you wish to use and redeem 2 coupons. It is not possible to redeem coupons or gifts valued at 0 NIS in conjunction with percentage-based discounts on the site.

**Granting Benefits at the End of the Order (Rolling Benefit)**
Benefits can be redeemed on the Italianos Pizza Online website or application in the purchase following the purchase in which the benefit was received. The benefit cannot be redeemed on the same order.
• The benefit received by the customer cannot be changed or exchanged.
• The benefit can be redeemed with a minimum order of 50 NIS on the website or application, for delivery and self-pickup only. There is no stacking of promotions, meals, benefits, or compensation.
• The benefit is not valid for in-store purchases.
• To receive the benefit via email and/or SMS, customers must consent to receive marketing materials from Clara Online.
• The benefit is valid for a period of up to 21 days from the date of the last order. At the end of the ordering process, the customer will receive one specific benefit for the next purchase (the benefit can be chosen from the list of offered benefits—images are for illustration purposes only). The benefit will be loaded automatically into the personal area on the site. To receive the benefit via email and/or SMS, you must consent to receive marketing materials from Italianos Pizza.

**Product Delivery Time**
The delivery time for products is in accordance with the time slots available for ordering and the information presented to customers on the site at the time the order is placed. Occasionally, the delivery time may change (due to extreme weather, road conditions, etc.) and will be clearly and prominently indicated throughout the site.

**Database**
All data collected and to be collected will be stored in the company’s databases and is under its responsibility.

**Use of Information**
The use of the collected information will be done only in accordance with this Privacy Policy or in accordance with legal requirements, in order to:
• Enable the use of various services on the sites.
• Improve and enrich the services and content offered on the sites.
• Change or cancel existing services and content.
• Purchase products and services on the sites—including advertising information, promotions, and content.
• Customize the advertisements and offers shown during your visit to the sites to your interests.
The information used by the company will primarily be statistical information, which does not personally identify you.

**Direct Email Mailing**
The company that leases the FoodBox site you are using wishes to occasionally send you information regarding its services as well as marketing and advertising information via email and/or SMS. Such information will be sent to you only if you have given your express consent, and you can cancel your consent and stop receiving it at any time. The company will not provide your personal details to advertisers. However, it may transfer statistical information about user activity on the sites. Statistical information transferred will not personally identify you.

**Provision of Information to Third Parties**
The company will not transfer your personal details and information collected about your activity on the site to third parties, except in the following cases:
• If you purchase products and services from third parties offering them for sale through the sites, the information necessary for them to complete the purchase process will be transferred to these third parties.
• In the case of using loyalty club software managed by a third party and under its sole responsibility.
• In the event of a legal dispute between you and the company that requires the disclosure of your details.
• If you perform actions on the sites that are contrary to the law.
• If a court order is received instructing your details or information about you to be provided to a third party.
• If the company sells or transfers the operation of the sites in any form—and in the event that it merges with another entity or merges the operation of the sites with the activity of a third party, provided that this entity accepts the provisions of this policy toward you.

**Delivery Time Commitment**
Italianos Pizza Online commits to delivering the order to the customer within the time defined at that time on the site or application. The time shall be calculated from the moment of receipt of the credit card company’s approval for payment of the order, whether the order is placed via the website, the application, or with a telephone operator. It is clarified that Italianos Pizza Online makes its best efforts to meet the aforementioned delivery times, but sometimes delays may occur, in which case the customer will be entitled to compensation, subject to their request to customer service.

**Important Information Regarding Gluten Allergens:**
Our kitchen operates in an environment where gluten is present, but we emphasize separation and take measures such as using separate utensils.
The gluten-free pizza is baked in a shared oven, on a rack with parchment paper.
Despite our best efforts, contact with gluten and unavoidable residues may occur.
These dishes may not be suitable for people with celiac disease or severe gluten sensitivity.
In case of severe allergy or celiac disease, it is recommended to consult a doctor and carefully consider the order.
The order is at the customer’s risk.
